Acceptance of terms

This Agreement contains the terms and conditions that apply to your usage of TeachingMusic.ca (hereinafter "the Site") and its related services. If you wish to use the Site or any related services, please read these terms of use carefully. By accessing this Site or using any part of the Site or any content or services hereof, you agree to become bound by these terms and conditions. If you do not agree to all the terms and conditions, then you may not access the Site or use the content or any services related to the Site.

Description of the service

TeachingMusic.ca is a website listing people who provide or wish to provide independent private music teaching services in Canada and other select locations around the globe (hereinafter 'instructors'). The information in the listings is as provided by instructors and may include instructor's description, photo, location and other information. Potential learners can use the website to find independent music instructors matching their requirements and send music teaching inquiries via a form on the Site to contact instructors.

TeachingMusic.ca is owned and operated by LEADGS MEDIA (hereinafter "The Company" or "We"), an internet marketing firm registered and located in BC, Canada. The instructors listed on the Site are not employed by the Company in any way and serve fully independently as independent providers of music teaching services.

The Company actively promotes TeachingMusic.ca and its content online, thus helping independent instructors find more potential students. For the service, The Company charges a commission fee which is included in public advertised teaching rates shown on the Site.

Instructors

The Company accepts listings from people in Canada, the USA and some select cities worldwide who provide or willing to provide independent private music teaching services. These can be professional music teachers, musicians or those who are confident that their music skills are sufficient to teach music.

A person who would like to be listed on the site is required to submit certain information which includes full name, contact information, city, information on your music background, experience, requested hourly rate, preferred teaching place, availability, optional photo. Upon submission, their profiles shall be reviewed and, if approved, start to show up online in the related city and music categories of TeachingMusic.ca. The instructors shall be able to edit or update their information or photo via the Site admin zone by using login and password used during the registration.

The Company shall provide instructors with additional details, terms and conditions once it receives the first inquiry for services provided by the instructor.

An instructor may delete or put on a hold his/her teaching profile at any time either via your admin zone by contacting us by e-mail at info@teachingmusic.ca.

Learners

People who consider hiring an independent music instructor (hereinafter 'Learners') can submit a music teaching inquiry describing their music learning needs and other preferences by using the form on the Site. It can be an inquiry addressed to a particular instructor or a general teaching inquiry in a specific city or town. The Company shall review the inquiry and forward it to the appropriate instructor, alone with learner's contact information. An instructor shall try to get in touch with the learner by using the contact details provided by the learner. If the requested instructor is unavailable or does not meet some learner's requirements, we can suggest the learner to consider some other instructors. We can further help establish an initial contact between an instructor and learner.

When an initial contact between a learner and instructor is established, they shall deal and communicate with each other directly without any involvment from The Company. This applies to all communication, discussion of all the details, arrangements related to the place and time for teaching sessions, their frequency, payment arrangements, teaching methods used, specifics of particular teaching sessions, etc. In particular, a learner is supposed to pay an instructor directly after each teaching session or as agreed between parties.

Our services are for persons 18 or more years old. By using any of the services on our web site, you certify that you are 18 years of age, or older. In cases where a parent is looking for an instructor for his/her child, he/she needs to send a proper request and take a due diligence when screening potential instructors, arranging or controlling lessons.

The Company cannot guarantee that each user is at least the required minimum age, nor does it accept responsibility or liability for any content, communication or other use or access of the Site and related services by persons under the age of 18 in violation of this Agreement. Also it is possible that other users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on the Site and that you may be involuntarily exposed to such offensive and obscene materials. It also is remotely possible for others to obtain personal information about You due to Your use of the Site, and that the recipient may use such information to harass or injure You. The Company is not responsible for the use of any personal information that You disclose on the Site. Please carefully select the type of information that You post on the Site or release to others. The Company disclaims all liability, regardless of the form of action, for the acts or omissions of other users (including unauthorized users, or "hackers") of the Site or related services.

WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that Your use of the website or the services will be secure, uninterrupted, always available, or error-free, or will meet your requirements, or that any defects in the Service will be corrected. HOWEVER: WE DO NOT VERIFY THE INFORMATION, VALIDITY OF ANY DOCUMENTS OR CLAIMS, MENTAL STATE OF USERS (INSTRUCTORS OR LEARNERS). WE ALSO DO NOT MEET ANY INSTRUCTORS OR LEARNERS IN PERSON. THUS, IT IS YOUR RESPONSIBILITY TO USE YOUR BEST JUDGEMENT AND BE REASONABLY CAREFUL WHEN COMMUNICATING WITH, MEETING OTHER PEOPLE OR ARRANGING LESSONS. EVEN WHEN WE RECOMMEND A TUTOR OR LEARNER BASED ON OUR PREVIOUS COMMUNICATION OR EXPERIENCE WITH THAT PERSON, IT IS YOUR RESPONSIBILITY TO TALK TO HIM/HER, CHECK ANY INFORMATION OR DATA YOU DEEM REASONABLE AND DECIDE IF YOU WOULD LIKE TO ARRANGE LESSONS WITH HIM/HER OR NOT.

IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY DAMAGES, DIRECT, INDIRECT, INCIDENTAL AND/OR CONSEQUENTIAL, ARISING OUT OF THE USE OF THIS SERVICE, INCLUDING, WITHOUT LIMITATION, TO DAMAGES ARISING OUT OF COMMUNICATING AND/OR MEETING WITH OTHER PEOPLE (INSTRUCTORS, LEARNERS OR ANY OTHER RELATED PARTIES) USING THIS SERVICE, OR INTRODUCED TO YOU VIA THIS SERVICE. SUCH DAMAGES INCLUDE, WITHOUT LIMITATION, PHYSICAL DAMAGES, FINANCIAL DAMAGES, BODILY INJURY AND OR EMOTIONAL DISTRESS AND DISCOMFORT.

Governing law and jurisdiction

All matters relating to your access to or use of the TeachingMusic.ca website, its content and any related services shall be governed by the laws of the Province of British Columbia, Canada and the laws of Canada, notwithstanding conflict of laws principles. You agree and hereby submit to the non-exclusive jurisdiction of the courts of the Province of British Columba with respect to all matters relating to your access to and use of TeachingMusic.ca website or any related services.
